RRA & Notice
I know there have been a few threads on this already, but I’ve attached the wording of the AST we signed last year for clarity.
My wife and I have had an offer accepted on a house. We have been renting the same property for almost 10 years and are trying to navigate our position on notice since the Rental Rights Act came in to effect.
We were on a 12 month AST commencing October 2025. Now that this has changed to a periodic tenancy per RRA.
In terms of notice, I appreciate it’s 2 months notice unless you have a different notice period stated in your original contract.
Ours says:
“At the end of the initial fixed term as specified in clause 2 hereof, the Term shall continue on a month-by-month basis until either party shall serve on the other a written notice to bring the same to an end.
Such notice, when served by the Landlord, should expire not less than two months after the same shall have been served on the Tenant. In the case of a notice served by the Tenant, such notice should expire no less than one month after service of the same on the Landlord.”
My interpretation of this is that RRA has ended the fixed term and our notice period remains one month, allowing us to serve this accordingly. Is my understanding correct, or should I brace myself for a painfully long negotiation on notice periods?
