Daughter's father evading child support
I’m looking for advice or experiences from anyone who has dealt with a parent intentionally avoiding child support. I already have a case open, but I’m trying to understand realistically what the court can do, child support agency hasn't been much help and doesn't answer much of my questions.
My hearing is next week for a modification in child support. Our mediation was a few weeks ago over custody, strangely the mediator said she doesn't handle the cs and that she thinks that will be brought up at the hearing. During mediation he told the mediator he wants our daughter out of his life and gave me full custody. Before this, he hasn't seen her in over a year and a half.
He works in the trades as an iron worker going on 8 years now. He has a pattern of quitting/getting fired (on purpose I think) before court hearings. He owes 7k in arrears and based off his pay chart, the cs should be A LOT higher according to the cs calculations in California. Last week he let me know he was "fired" right before the hearing. I’m trying to understand what courts typically do when a parent appears voluntarily unemployed or underemployed to avoid support. Can California courts impute income based on earning history/trade experience? What evidence is helpful in these situations?
