There is a need to confer with opposing counsel before filing under the FRCP. However, you cant serve until your complaint is accepted, so before this there’s no opposing counsel in the picture.

So can you file all motions ex-parte at this stage? There are non TRO situations, like evidence preservation w/ 3rd parties, or writ of mandimus where say a zoning decision is heavily adjacent to the suit.
