


Is this right?
Need some help here my fellow Malaysians!
Context:
I handed in my resignation last month on the 29th of May,
I was thinking to utilise my remaining balance of 12 Annual Leaves to shorten my notice period.
I understand by labour law that Leaves being prorated are totally normal but what was stated on the contract is that I would be “entitled to 10 days AL UPON CONFIRMATION”, even the “balance” on my payslip shows 12 days.
My manager and the new HR (one person) both told me that I was only allowed to take 2 from last year 2025 and 5 from 2026 which kinda got me thinking if I did in fact misunderstood what was starting on my job contract.
FYI, my contract supposedly was from 1st August 2024 until 31st July 2025 which already ended but I’m still working until now without any renewals & I have already taken it as I’m just here fulltime.
I did call my boss about this too & he still says annual leaves are prorated even though my contract and payslips says otherwise, he blamed it on the last person who was working as an accountant (wfh) for the company.
