Back pack as carry on?

We are flying out tomorrow. My ticket includes both a personal item and carryon. I was planning on using two backpacks, a small one as my personal item and a bigger backpack as my carry on. Both fit in the size requirements for their respective baggage types. However, someone recently told me that flight attendants will not let you put a backpack in the overhead bin at all. Is this true? Even if the backpack IS my carryon and will not fit under the seat?

Using the larger backpack as my personal item is not an option. It is a hiking pack that I will need for my trip and it is way over the size limit to be my personal item.

TLDR: Can I use a backpack as a carry-on or will I encounter issues putting it in the overhead bin?

Delta - Latam checked baggage fees

I have booked a flight via Delta from North Carolina - Atl - Lima. The first domestic leg is operated by Delta and the second one by Latam. I have not been able to get exact information from any of the customer service teams regarding the checked baggage policy. Do I need to pay for bags even if I have the Delta Amex Gold card?
