Sued in NYC by a Junk Debt Buyer

Hi everyone,

I am a pro se defendant in a consumer debt lawsuit in Brooklyn, NY. The plaintiff is a major junk debt buyer, represented by a high-volume collection law firm.

The alleged debt originates from a Navy Federal account for roughly $18k. I timely filed my Answer to prevent a default, and my first court conference is June

The firm just sent me a settlement packet offering a $500/month payment plan (which I will reject). I want to leverage their paperwork vulnerabilities into a steep lump-sum settlement or a dismissal.

Here is my ammunition:

  1. Defective "Nail & Mail" Service: The process server logged 3 attempts, including a weekday morning when I was at my full-time job (I have pay stubs to prove it). The affidavit relies on an "unnamed neighbor." I raised personal jurisdiction in my Answer and want to push for a Traverse Hearing.
  2. Incomplete Billing History: The earliest statement they provided is from June 2022, but the balance starts at $17,949. They have zero line-by-line history showing how they actually arrived at that final amount from a $0 balance.
  3. Weak Chain of Title: The Bill of Sale is generic and doesn't mention my account. They just attached a screenshot of a spreadsheet line with my redacted account info. Under the NY Consumer Credit Fairness Act, this is notoriously weak without an explicit affidavit from the original creditor linking my specific account to the sale.

My Questions:

  • Has anyone successfully pushed a firm to a Traverse Hearing in Brooklyn? Do they usually drop the case or show up?
  • How strictly do Brooklyn judges hold debt buyers to the "complete line-by-line billing history" rule? Is the missing history below $17.9k a solid wedge?
  • What should I expect at the June conference? I plan to reject their stipulation in the hallway and ask the court for a formal discovery schedule.

Any advice from NYC consumer defense folks would be massively appreciated!
