Tenant swap under RRA - does the 12-month protection reset?
I'm planning to sell my property in about 12 months. One of three joint tenants is moving out and wants to find a replacement.
Pre-RRA this would have been straightforward - a deed of assignment or an addendum to the existing contract. But I understand deeds of assignment are no longer recommended for APTs, and a new agreement would likely reset the clock on Ground 1A.
My question: if a replacement tenant is added, does their 12-month protection period run from the date they join, or from the original tenancy start date?
It might not be an issue for this particular swap, but if another tenant then leaves in a few months' time, I could end up in a situation where I can't use Ground 1A to sell for considerably longer than expected.
Does anyone know the correct mechanism for swapping a joint tenant without creating a new tenancy? I can't find a clear answer to this question.
