What makes a SaaS irreproducible when someone else can recreate and deploy it within couple of days using AI

During the time of pre AI, it would take months to years with a team of 5-6 people to build a refined product. It would be difficult for competitors or any other people to copy that as they would be behind by months and require decent budget. These days, thanks to AI, you can build and copy someone’s product in days to week (Not all but most of it). What makes a SaaS in their early phase unique and irreproducible?

Do people usually have LLC when they start their SaaS?

I’m curious if people have a LLC when they start their SaaS. I know that most of the early phase SaaS have no revenue and don’t really care about doing their SaaS business under a LLC as it may cost some money and time for all the paperworks. However, is it safe and better to take that extra step just incase some other business decides to sue you? At least in US it’s common for a business to find some reason to sue similar emerging competitors if they see it as a threat. Hope many SaaS owners have LLC under their name?

Can YouTube sue me for transforming their course videos into a Udemy/Coursera style course format?

Hi, I launched my first app called Tubeemy. (www.tubeemy.com
) The main purpose of this app is to simply paste YouTube link and it transforms the video into a Udemy/coursera style structured course where the video is divided into multiple modules, users can save track progress, and add notes, and take personalized quiz. My question is if having a YouTube player is allowed for a 3-rd party app? I have seen many random websites having YouTube player attached in their websites so I assume the answer is yes but just wanted to conform with the community
