Removal proceedings, Vawa, pending
I’m currently in removal proceedings in Atlanta based on a B2 visa overstay from 2015. I entered legally and recently received an NTA under INA 240 / 237(a)(1)(B).
At the same time, I have:
- Pending VAWA I-360
- Pending I-485 adjustment of status
- Approved work permit and travel document valid until 2030
My lawyer wants to file a Motion to Terminate my removal proceedings, but my VAWA is still pending (not approved yet). The legal fee would be around $3,800, and I’m trying to decide if it’s worth spending the money now or if I should save it and just continue the case until the I-360 is approved.
Has anyone here had removal proceedings terminated while their VAWA was still pending? Or did the judge just continue the case until USCIS made a decision?
Would appreciate hearing realistic experiences, especially from anyone in Atlanta immigration court or with VAWA + removal proceedings together.
