My mom entered US on B2 this January and my US citizen sibling filed i130 with AOS within 4 days thinking it is to establish relationship. My mom visited many times and entered overstayed. She retains all her assets in India and also has a return ticket in July. She is recently widowed in November. Since 90 days passed, is it safe to file 485 or this is risky because i130 filed immediately? Asked many attorneys, everyone has their own version. Thought of asking here too.
