AC hasn’t been working, Landlord says it’s not hot enough

hi all, i live in a home/building turned apartment complex shared with my landlord & another tenant. our AC hasn’t worked for over a year, last summer we had to put a window unit in (it only cooled the main area, did not reach our bedroom) we have repeatedly asked our landlord for HVAC to come out and have a look. our apartment will reach 80°+ with fans going inside and the AC “on”

our landlord has told us that the AC shouldn’t be used until it’s over 70° for at least 3 days straight. i have never heard this before, but the issue is our apartment will heat up (on the second floor) even if it’s 65° outside. we have only turned the AC on when our apartment reaches 75° or over inside, at that point it’s hard to sleep or do anything inside.

are we correct in thinking that our landlord needs to fix the AC regardless of outside temperature?

we asked for a tech to come out but he said it needs to be 70° or hotter consistently for at least three days before they inspect anything as that’s “standard conditions”. i’d love to hear some advice from people who know what they’re talking about and actually understand HVAC issues
