Many beneficiaries will be able to establish that they have original scientific, scholarly, artistic, athletic, or business-related contributions, but Part One also required that they be of major significance in the field. In addition to discussing it in Part One, it should also be discussed in Part Two since many of the same arguments as to why the original contributions are not of “major significance” can also be articulated to show that they are NOT indicative of the beneficiary being one of that small percentage who have risen to the very top of the field of endeavor and enjoying sustained national or international acclaim.
This is ultra vires, not in the regs, not template language. It appears to be officer guidance floating around that should not be there. If you have this language in your denial, or if USCIS calls you by the wrong job title, misgenders you or conflates the Kazarian steps, you have options. We are litigating these cases and USCIS is responding.
