For my understanding he claims that OpenAI took advantage of the tech that they had developed while being a non profit, and used it later for their for profit version. Now he wants some reimbursement.

But... didn't he do the same? He had the access to OpenAIs tech and data during his time there between 2015-18, and after quiting he went on to found a separate for profit company Grok, that used the tech that was developed by the non profit OpenAI.

Both Musk and Altman used the tech that was developed during the non profit period of OpenAI for their later for profit projects, how is Musk who is suing Altman is any different than him?
