Hi everyone, I need some advice regarding a salary dispute with my previous employer in India.

I worked as a Software Engineer and resigned on 23 Jan 2026 after completing all formalities. However, after leaving:

My salary for Jan, Feb, March 2026 (~₹1.5 lakh) has not been paid

Around ₹52,370 has been deducted under “Amercement” without any proper explanation or supporting data

The company is refusing to release Full & Final settlement unless I agree to their terms

They had promised to pay by 7 April, but no payment has been made

👉 The key issue:

The company is saying they are ready to pay ₹97,630, but only if I confirm over email that I accept this as full and final settlement.

My concern is that:

My actual dues are around ₹1.5 lakh + illegal deductions

If I agree in writing to ₹97,630, it might weaken my legal claim for the remaining amount

Also:

They have not provided Relieving Letter / Experience Letter

No transparency or justification has been given for deductions

Sent a legal notice (no response)

Filed complaint on Rajasthan Sampark

Filed case on Labour SAMADHAN portal under Payment of Wages Act

My questions:

  1. If I agree to ₹97,630 over email, will it legally weaken my claim for the full amount?

  2. Should I reject this and continue legal action, or try to negotiate?

  3. What would be a fair settlement range in such cases?

  4. How strong is my case under the Payment of Wages Act?

  5. Any tips for handling conciliation or labour officer discussions?

  6. In situations like this, where salary is withheld and payment is being made conditional on accepting a lower settlement, is it advisable to file a police complaint or criminal case, or should I stick to labour/legal remedies?
