Brother delaying probate application - England
Title says England as that is where my dad died, but I am currently living abroad.
My dad died in October and my Brother and I were the only ones named in the will, so the house he owned should be falling to us via inheritance. We are both executors in the will.
The problem I am having is that my Brother has both the Death Certificate and the Will and I have neither. He did ask me once about the probate saying he was putting the application in in December, but to this day he has not made the application.
I know I may sound insensitive like I am trying to rush the process, he has mentioned it since and said he hasn’t applied yet because he is still grieving, but it’s now almost June & I would honestly just like to get it over with.
My Brother and I aren’t on the best terms and he won’t give me copies of the will or death certificate so it’s not as simple as just asking for them so I can do it myself. I feel like there isn’t anything I can do, especially being abroad, as even if the house was transferred to our names I would still need a mediator to get the house sold which we have both agreed we want to do.
Do I have any options here or do I just have to wait for him to do everything?
Potentially relevant - I did approach the idea of using a third party for the probate application even if they take a fee, but he was against this idea and vehemently wants to do it himself. He just… isn’t.
