[TX] Lease was up April 30th. Property Manager asked me to move out sooner, I moved out on March 15. Deposit Deduction list received on May 18th.
My husband and I were renting a single family home for 3 years. 90 days before our lease was up, my husband got a call from the property manager asking if we would be willing to move out early as the home owners wanted to move back in. If not, we would need to move out at the end of our lease on April 30th. We didn't give him an answer and told him we would think about it.
A month later he reached out and asked if we were still thinking about it. At this point we had went ahead and started looking at other rental options.
My husband told the property manager we were going to go ahead and move out early but we did not have a day yet as we were looking at places to live.
We applied to a few and got conditionally approved for one with a March 15th move in date.
The property manager got the request for residence confirmation from the new property management company and confirmed with us that we would be moving with his approval. He congratulated us and reminded us that we had to have the home professionally cleaned at move out. We confirmed we would hire someone.
Fast forward to March 15th. The house has been cleaned and the property manager does not work Sundays. He did not set up any sort of move out walk through. I sent him a email summarizing that we had hired someone to clean the home, all of our stuff was out, and we left the house keys on the kitchen island after looking up. He emailed back early the next day confirming receipt and said he would be in touch.
It is now May 19th. We received an itemized letter in the mail (from the home owner) stating that they were withholding our entire deposit due to needing to replace the floors and having to deodorize the house? They are also charging us an additional $350 outside of our deposit for a broken closet door and kitchen cabinet door repair. I did not agree with these charges so I went to Google the process of rebutting. Then I stumbled upon the Texas property code. Are they past the 30 days they had to get us the itemized list? It has been 64 days since we moved out of the home. Or did they have 30 days from our original April 30th lease termination? We have no signed form stating that our lease termed on March 15th, only texts between the property manager and the email I sent on move out day. They did not withhold any money for owed rent, so would this be confirmation that they agreed to the March 15 move out day?
