Ah fuck competency
so I’m new but like fuck competency proceedings. have my first few cases where client is clearly 100% suffering from mental illness, probably, like I’m not an expert of course but clearly nothing I say is getting across. Yet these guys clearly get being in jail sucks and would do anything to get out. But they don’t have like $250 sitting around for bond. And there is no support system in place. So now I just have to file a competency motion or something I guess?? And just make them sit in jail for months until our overloaded mental health system takes them. And then who knows what happens. Some of these cases would be good fights too . . . if the client could get there
Fucking sucks. So much of the criminal system is just getting different categories of people in the state’s crosshairs but filing a competency motion is one of the only times where it feels like I am the one pulling the trigger.
