I just quit a virtual intensive outpatient program. I wasn't able to proceed with the intake process without signing a digital consent form allowing them to record. I called to try moving forward without signing, but I was told to complete all paperwork before I could continue.
After my first session, I found out the recording program also uses AI. I called to rescind my consent to be recorded on April 16th. The program continued showing up and recording my sessions for up to 45 minutes before it was removed.
I called again to complain on April 29th. I was told that because I opted out, I was no longer being recorded. However, my zoom window was announcing "this meeting is being recorded" and the red recording indicator was visible.
Yesterday, May 5th, I called again because the recording program was in my session. The person I talked to this time told me that all recordings of my sessions that were recorded after I opted out are in the process of being deleted. I asked what AI program they were using and they would not disclose that information.
My questions:
- Have they broken any laws by recording my sensitive therapy sessions and feeding it to an undisclosed AI after I have opted out? Or am I at the mercy of Oregon's one-party consent for virtual meetings?
- Am I entitled to know what AI programs are accessing my sensitive information?
