Looking for next steps

Location: Colorado and California

My husband was recently denied his short term disability claim. He's been paying into the short term disability policy since July of 2025 when we had a life-changing event (I got pregnant). He was injured in January of 2026. Their reasoning for denying his claim is because he failed to sign up for the policy within 30 days of when it was initially offered, which they stated was in January of 2023. The issue is that the company that offered it didn't merge with the company he works for until June of 2024, and they didn't merge their insurance offerings until that November during open enrollment from what I can remember. My husband's store location is in Wheat Ridge, CO and the new parent company is located in California.

None of this is making any sense. First, they denied based on him failing to sign up for insurance offered by a company he was not yet employed by. Second, why offer the policy if the only way to be approved for it was to sign up within 30 days of them initially offering it?

Can anyone recommend the next steps for us to take? We've got roughly 177 days to appeal in writing.
