Is this job following labor laws?
I got interviewed at a restaurant in Chicago where the manager told me to come in the next day for training for a 4 hour shift. I came in that day and the manager was not there. Someone clocked me in and showed me what to do and asked me about my job but I had no details whatsoever except that it was for dishwasher. I didn’t know a schedule or pay or who was to train me.
Anyways I work for 4 hours and leave and have a fine shift and get the mangers number to see when I can come back. He never replies. So I call the store in a couple days to see what’s up and the manager says he makes the schedule over the weekend and will call be back later. He never does. After a week I was worried that this job was just gonna forget about me and say I never worked there because I never signed any paperwork.
So a week later I text the manager again saying I’m expecting my paycheck for my four hours of work and I have my documents to do any paperwork and mention that I don’t want any legal trouble. He answers and says come by tomorrow with my information. So I come by and do a single page that just asked for my name, address, SSN, emergency contact. Also the manger was adamant that I give him my ID and SSN card but I had my passport which is a type A work document and he didn’t want to look at it. But I had my SSN memorized and just wrote it down.
He didn’t look at any sort of employment verifying documents and just let me do this which I think is very unlawful. The paper work also asked for information like rate of pay which I didn’t even know since I never got an official offer. He then stated that I come by to get my paper check whenever it’s payday. He then noticed that I put the stores name on my resume (I applied to a different position after I worked the dishwasher) and said that I was never hired here and even called me a liar for that. He says he just wanted to see if I was fit for the job even though he was never there when I worked on the “training” day I did.
I basically washed the entire restaurants dishes that work day and it was not just a trial shift to show my skills it was beneficial work, it was also never considered to be a trial shift and his words were verbatim “training”.
I am concerned this store is doing illegal labor tactics. Especially since the whole back of the store is all people who only speak Spanish and some speak a bit of English. My coworkers on that day were extremely nice and helpful to me and asked when I was coming back and some even said to come back tmrw at the same time as I did that day but I didn’t listen because I didn’t want to waste my time and be told to go home. Also the day I worked they made me clock in on a machine. I’m also curious as to whether I should be paid for my time at the store doing that paper of information for him.
