I want to buy a house. For 40 years it has been served by a private road that leads up to (and is owned by) a nearby farm. The owner of the home died. The owner of the farm died. The widow of the farm owner no longer wants to allow the private road to be used as a right of way - only 100 ft, of what is quite a long road. The only other access would be from a different road. It would require building a 1000-ft road, cutting down dozens of trees, and building over marshy ground. It is such a costly endeavor that no one would do it, creating an unlivable property. I think there is an argument that the house is effectively landlocked, and there should be a short right of way from the private road. Not seeking advice, just wondering if such an arguments exists
