My company started by perm process late 2024. It eventually got approved in March 2026. However, during this time, the prevailing wage has been increased for my designation.

When the time came to apply the I140, the attorney said the current salary is not in line with the updated prevailing wage. According to the attorney, they said my company needs to refill the perm which could take another one and a half year.

My question is, is what the attorney saying is true or can I still ask to proceed with the I140 process and deal with the RFE?
