Trying to determine if there is a point in filing an I-212 at this point
My wife's spousal IR1 visa interview was today. She has 6 months left on her 5 year ban. The consular officer literally winced and it seemed like they might approve her, as he said "...you only have 6 months left...." but ultimately he gave her a sheet telling her to file an I-212.
What happens to the IR1 application at this point? I was hoping they would let us come back in 6 months when her ban is over and she could he approved.
An I-212 takes 3 years now to process, so I don't see how we could be so punished versus if we had had our NVC appointment 6 months from now.
