I fucked up!
Yesterday my attorney sent me an email about a couple protective orders that needed filed before a deposition later this month. He never CC’d me to the original thread so I had no clue about it. He seemed stressed, like they needed to be handled ASAP so the judge could get them signed.
I drafted them, got them approved by my attorney and the attorneys for the third party being deposed, and just went ahead and filed them.
My attorney was like “hey please recall these I need to get them approved by opposing counsel first” and I was like OH SHIT. So I went on our eFiling system and was able to recall one of them, but no option to recall on the other one. I called the civil clerk and the Court is closed for a state holiday.
I emailed the clerk and now I have to wake up an hour early to call and get it recalled on Monday morning. Attorney doesn’t seem stressed and it’s not a big deal, I just hate messing up. At least it’s not going to be accepted because the Court is closed. Further, if he sends for OC approval today, I may not even need to recall it.
