Business Liquidation - Can I still pursue a claim?
I am pursuing an unfair dismissal and discrimination claim in England against named individuals (perpetrators of the discrimination) as well as the company itself.
I suspect the company may be put into liquidation prior to my claim reaching tribunal to avoid the payment of any award. In those circumstances can I still:
a) pursue a claim against the named individuals (my current understanding is this would only be for the discrimination element)?
b) amend my claim to name the new company which is fundamentally the same as the previous company (franchised through same group, same employees etc.)?
Are there any other options/ suggestions to help claimants in this position? Feels unfair that a company can close itself down to avoid paying an award just to pop back up again…
