Emotional Damages Claim
My husband and daughter were involved in a motor vehicle accident where the other party was found to be 100% at fault. My daughter who is 7 yo suffers from baseline medically diagnosed anxiety but after the accident this significantly worsened for about 2 months. She had visits with her psychiatrist and her medication was increased. We have documentation from the visits where her physician attributes this to the accident.
The insurance company is offering what we consider a low offer for emotional damages stating this is because she didn’t have a physical injury. However from my own research, I feel like you can still file for emotional damages without physical and they are just trying to get us to settle.
This is specifically related to Geico in TX. Has anyone else ever been in a similar situation? If so what was the outcome? Any tips or tricks to negotiate with a Geico adjuster that isn’t budging?
