For those with a dismissed criminal background, how long did it take for your H1B change of status or extension to be approved

Here’s the timeline of my situation: On May 27, I submitted an RFE about my criminal background, premium processing paused on May 29. All charges were dismissed. The first involved a DUI—I wasn’t paying attention while driving, and the case was dismissed when no alcohol appeared in my system. The second charge was for drug possession: I was with friends, one holding a controlled substance I didn’t know about, and I was exonerated. My last USCIS response came on June 12, and as of now, I’ve heard nothing. My case status states that USCIS is still reviewing your case. paused premium processing on May 29. My case has been going on past the one year mark.

H1B Case Is Still Being Processed By USCIS.

Nigerian here. I have an H-1B I-129 in premium processing that received an additional RFE related to two dismissed arrests (no convictions). USCIS received my RFE response on May 29, reset the premium processing clock, then issued the “premium processing clock stopped and notice mailed” update. My case has remained “Case Is Still Being Processed” since June 11. I’m also currently in my 60-day F-1 grace period and trying to determine my backup options if the case continues to be delayed. In your experience, how common is this timeline for criminal-history RFEs? Does a longer post-RFE review usually indicate additional background/security review, or is it simply normal adjudication? Have you seen similar cases ultimately approved?

H-1B Delayed After Criminal Background RFE – What Are My Options?

I’m currently in my 60-day F-1 grace period on DAY 1CPT, and my H-1B is still pending after responding to an RFE related to a dismissed criminal case (no conviction). USCIS received my latest RFE response on May 29, and the last status update on June 12 says my case is still being actively reviewed. What did you do to maintain status, and did enrolling in Day 1 CPT while the H-1B was pending cause any issues?

USCIS change of status delay

Hey everyone, is there a way for me to get an immediate response from USCIS regarding my change of status from F1 to H1B? Below is the timeline of events:

- I recently responded to a second RFE regarding my criminal background, but unfortunately where no conviction was involved, it was a DUI and drug possession. I didn’t show up to court. I was exonerated and the case was dismissed completely.
- The review process is taking too long, and I’m two days past the premium processing deadline.
- I’m in a very tight financial situation and at risk of losing my job due to this delay.
- I recently graduated and have about 60 days or less left in the US. I am 4 days in have taken a temporary leave of absence from work 

I’ve tried calling the phone line, but it’s always busy. When I tried the live virtual chat, I was still told to speak to a person on the phone line.
