Update on shared appreciation clause and QWR. Still confused?
Sorry I can't update my original post.
Quick recap Im dealing with my deceased parents property, got the Payoff from PHH mortgage and saw it had a Shared Appreciation Clause.
I requested a QWR for all original signed loan documents. I received paperwork that shows they assumed the loan in 2009. The Shared Appreciation Rider is from 2012, it only had my father's signature (someone put NA on my mother's signature block?) No lender representative signature. And the date of my father's signature is 11/25/12, the digital fax receipt shows they received this document on 10/25/12. Oh and there is no approved waiver for my Mom's missing signature.
So is this rider enforceable on their end? Is it time to find a real estate lawyer?
