Right to property after separation but not divorced. England.
Hi. I am looking for some advice please. I am 63 and am at a point at separating from but not not necessarily divorcing my husband who is 68. Our home, mortgage free is in both our names, joint tenants. My husband wishes to remain in the home and has therefore suggested equity release as a means to release cash for me to purchase elsewhere. The amount available would be greater if my name was removed from the deeds given the age difference between us. So my question is, assuming he dies before me, and my name is no longer on the deeds, BUT HAS BEEN, am I still entitled to any remaining equity in the house. Or does this have to be specified in his will as he does have two children from a previous marriage. Any advice would be appreciated, thank you.
