Long read but hope it at least shows others they are not alone in this bullshit work comp system!!
Just when I thought work comp couldn't get any worse it goes full mind blowing unreal!!! I was injured in 2017 having had both hands/ wrists crushed in industrial door that I had written up many times in my DOT log, left hand and wrist were the worst injuries with crushed pisiform, crushed sagital bands, internal lacerations from fragmented bones, etc....the urgent care casted up the left hand up the forearm, braced the right. Was told they would send help on my rig/routes with me but could not find anyone to fully take over my route while awaiting surgical consult, help rarely shows up and or is useless, but even telling them I can't keep up my position that I'm blowing out my right hand as well I get told I'd lose my job if I didn't show. 4 months go by and I finally get a surgical consult that takes me off work and need immediate surgery, another month until first surgery 5+ months post injuries, Sedgwick only approves some of the surgeries needed, Dr does a few repairs/reconstructions then releases me back to PCP to send me to an Ortho specialist as my injuries are too severe and this surgeon didn't like Sedgwick not approving the surgeries needed, Sedgwick takes the release as a release back to duty which I try to then get a lawyer that doesn't respond quickly enough that I didn't have to go back to work but my dumbass doesn't wasn't to be fired so I go try to do the light duty which fully blows out my right hand as my left is in a surgical cast. Back off work now and needing more surgeries, this goes on for years of back and forth of what Sedgwick will approve or not and blowing surgeries out as they only approved occupational therapy and strengthening not rehabilitation... Had my last surgery about 8 months ago which resulted in another failure, I have had my wrists fused, a pisiformectomy, all ten digits sagital bands repaired/reconstructed at least once with some blowing out after 2 to 3 repairs, multiple extractions of tissue/fragments, debridements, trigger release on 5 fingers,dual thumb arthoplasty with severe loss of motion and range almost locked in place other than occasionally subluxing out of place as several of my digits now do. I have seen a QME so many times that they now state this is fully sedgwicks fault and my attorneys for excessive negligence in my case, last rating at 100% disabled as I've had so many surgeries fail with no more harvest tendons to extract and cadavers failing or not being a viable option, I have now had to be on heavy antidepressants that I've never needed pre injury, heavy pain regimen again never been on pre injury was commercial driver so not allowed to take DayQuil without worrying of a random drug screen, have now been on pain meds for over 8+ years. Now here's the new just omfg moments in this horror show, my PCPs practice went under no longer exists, and without much warning to find a new one which holy sheep shit is that a hassle, so after years on pain regimen I no longer have a Dr to prescribe them and start going through what I thought was heart attacks and COVID on speed turned out to be severe withdrawals, and ironically sedgwick sees I'm not being seen by a PCP and asking for a new one that they stop approving my psych as well after years on those as well, full mental breakdown ensues, my marriage is now over as my wife had always been disabled herself since childhood with brain tumors and severe issues requiring a vast amount of shunt surgeries with lots of complications and I had always been her caretaker and bread winner, well with no income and work comp hell we are now on housing programs, and welfare and are barely surviving, she no longer considers me a man as I've deteriorated from a 6'3" 250 strong man to a 6'2" 290 shell of what I used to be, used to bench 350 easy now hands pop and snap on trying to grip bags of groceries. My children have started to resent me as we used to do camping and work on cars, electronics, and woodworking as I grew up being very mechanical and loved working with my hands and teaching my boys how to be self sufficient and now our tools sit in dust/rust and camping gear in a storage unit for years now, we have 3 children that fight constantly after watching their mother and I battle daily. I recently had my thumbs snap as I had to slam on breaks to avoid an accident and slammed into wheel/dash with the knobs I have on my wheel to help drive causing some damage and now have several herniated discs being l3,L4,L5 and damage to t7,c1 discs. My lawyer which is the 4th one I've been switched to now is stating I should just settle as I've asked these new injuries to be included and evaluated by QME as the urgent care dr said it's definitely due to hands giving out again. Lawyer states can't get much higher than a rating of 100% but I need newer restrictions as I'm trying to get on social security as I need an income but have been told I won't be able to go back to prior lines of work being construction and commercial driving as DOT has taken my commercial license as I can't pass the physical and have started taking thc/CBD tabs while awaiting new Drs/pain management, which are not my thing as never was able to use THC before and don't like being foggy or "stoned". Sedgwick has got to be one of the rings of hell, and even my lawyer seems to just not care or follow through with anything, I have a QME of 100% and a Psych QME of 40% permanent which I've heard are very high ratings I can't understand after all this why my lawyer isn't doing more or how Sedgwick can continue to not respond to new requests for a new PCP and pain management, not deny just not respond and it's been months now. I had someone write me on another thread saying I need to go after Sedgwick and my lawyer for negligence/misrepresentation but have no idea how to, I've lost my marriage and family that was once such a great life and am on the verge of being homeless due to budget cuts in housing programs, I just want to go back to being productive and providing for my children at least because I e found out my wife has been unfaithful and unbearable to even be around now I dont want to salvage that, but she threatens that if we separate she'll take half of my settlement which she has done nothing but make my mental and physical health worse, as she can't drive due to her condition forcing me to on hands that are deformed and deteriorating. If it weren't for my children and the fact I know they would have no one to take care of them as we have no family or friends and I don't trust her to be able to take care of them as she can't even take care of herself,then id go for an ocean swim and not look back.
Any advice on how to see what job I could do or how to hold lawyers/Sedgwick accountable would be lifesaving at this point as I'm losing my mind at this point with what social security wants in new restrictions and what I'm not getting with no pcp or good lawyer to advocate. Thanks in advance!!
