
Guidance on Advisory Opinion follow up
Hi all,
We have a pending I-485 RFE for AOS regarding subjectivity to 212e. To respond to the RFE we reached out for an Advisory Opinion within a few days of receiving the RFE. My wife sent in the request on April 3rd and got a confirmation of receipt on April 3rd.
No status updates until April 27th. It's weird that the status shows the request coming in on March 30th and that isn't right. We have until June 23rd at 1200 AM EDT to respond to RFE so things are getting really tight.
If I go by April 3rd receipt date then we are only just getting to the 6 - 8 week window and we should probably until after 8 weeks to follow up right?
Or do you think the 6 - 8 week waiting period actually started on April 27th? If so, the 8 week mark is right at June 22nd which is our due date for the RFE.
I'm very concerned at this point. Our AOS case was going very smoothly and quickly. The officer was just unsure on 212e and needed supervisor input after our interview. We then waited two months post interview only to get hit with this RFE. I asked in our interview if we should get an Advisory Opinion and we were told not to do anything until they followed up.
For reference, my wife is from Colombia and here on a J1 as a teacher. We apparently carry the burden of proving that the government updated the skills list in 2024. Frustrating.
I don't want us to complicate the advisory opinion process by reaching out too soon or unnecessarily. Does anyone have any guidance or have similar experience?
