Need advice for issue w/virtual assistant company

We’ve used a virtual assistant company for several years now and we love our admin.

I just learned that they (Virtual Assistant company) have failed to pay all of their assistants/employees this month (not the first time, apparently). Even though I pay them on time every month - including for May - they have not yet paid the assistant that is contracted with our firm.

I also learned that even though they originally told me that they pay all health benefits for their employees - a fact that sold me on their services to begin with 3 years ago - they stopped covering her health, vision, and dental insurance 2 years ago (without notification).

They have had a lot of turnover and I’m concerned that they are overextended.

If they don’t get her paid by next week, thoughts on our options? I don’t want to lose her and I’d consider hiring her directly, if possible. She works and lives in Colombia, so I know there are legal intricacies related to an international hire…I’m not entirely certain how to navigate this.

Any advice/suggestions? I need to get a copy of the Service Agreement because I’m not sure what the solicitation clause is, but I also view them as currently being in breach.
