TN rejected, Try new border with changed JD, or demand USCIS pre approval?
Hi all, need some quick advice on my next steps.
I am canadian, I have a BSc in Economics. I applied for a TN visa at the border under the Accountant category.(Job title: Cost controlling)The officer said my degree doesn't match and allowed me to withdraw. However, they scanned my original support letter and recorded the attempt in the system.
My company's lawyer now wants to completely rewrite the Job Description to fit the Economist category and have me try at a different border crossing next week.
My worry: Since the original letter (with accounting duties) is already in the system, won't the new officer see the completely changed JD for the exact same job and flag it as Misrepresentation / Visa Fraud?
What should my next step be?
Should I risk trying a different border with the new Economist JD? Has anyone survived doing this right after a withdrawal?
Or should I refuse the border attempt and demand they file USCIS (I-129) pre approval instead.
