I WFH and we use an activity tracker to monitor productivity. We are allowed a percentage of our total work time for non productive time. Non productive time covers everything from mandatory team meetings, emails, research, etc.

This allowed time is a percentage of our total worked hours. Usually based on a 40 hour work week but if we use PTO those hours are excluded. For example, if I use 32 hours of PTO in week my allotment of non productive time for the week is based on a percentage of 8 hours. If I had 2 hours of mandatory meetings on that one day I would have 25% non productive time for the week. We are allowed up to 15% and are subject to discipline (including termination) if we exceed 15%.

Today we got updated guidelines and now our mandatory breaks and bathroom time are counted as non productive time.

Break time is based on WI labor laws and it's my understanding that employers must allow employees use of bathroom during work hours. Is it legal to be subject to discipline for bathroom and mandatory breaks (or meetings for that matter)? It doesn't feel right to me that I can potentially be disciplined for bathroom and legal break time. Can anyone tell me if this is even legal?

My fear is that they are planning on outsourcing work and first we were told jobs wouldn't be lost which changed to we don't anticipate jobs being lost. I fear that this new policy is being set up so that they can fire us for cause instead of lay offs.

I'm trying not to freak out. I have IBS and some days require longer bathroom time. What are my rights?
