Overstayed visa in past now greencard holder, want to travel
hello, my husband was on DACA. he got a DUI in 2013 for drinking and driving and was placed on a one year probation and then it was expunged in 2014,
since then he has had no criminal history besides some speeding tickets which have been resolved. Due to this, he did not renew his DACA so he was actually undocumented for a few years… He got his green card through marriage with a US citizen spouse (me) in 2023 and the DUI was brought up and addressed, and he still got his green card after we provided all the court documents.
we have a bona fide marriage. We have a child through this marriage as well as shared businessss and enough proof. we have applied for his I751 removal of conditions In Jan 2025, and it’s been in progress and January 2026, We actually applied for naturalization for him and it’s been in progress. His two-year green card expired 2025 last year and he has the 48 month extension letter. Last year we’ve traveled to several places and have had no issues coming back. With the current political climate, we have a trip Italy booked…all of our relatives and everyone is telling us not to risk it because we have too much to lose. we have a child, etc., and we don’t want him detained or have trouble coming back.. People are saying not to travel or that it’s not worth it however, we have a very clean social media and a clean record. We have a medical practice that we both own. our immigration lawyer, who is a very very high profile well reputed immigration lawyer in the area, She has no issues with us traveling and she actually encouraged it however, we are nervous after everyone’s feedback. Any feedback would be appreciated. Is it even worth traveling right now for a leisure or should we just limit travel to emergency travel as needed until he gets his citizenship? thanks!
