This is a very complex situation but I'll try to keep it brief. I'm a university student in England and I went to a nightclub where I met a girl. I was looking for my friends and didn't notice her at first, but she started touching me and grinding on me so I began to touch her back. She started to kiss my neck (leaving a lovebite). At one point she got her phone out and I added her snapchat. I put my hand down her pants and put hers down mine. She did not resist at all and began to stroke my penis. We didn't say anything to each other that I can remember, but she clearly wasn't uncomfortable.
I then walked with her to the toilets. She wasn't stumbling at all and could see exactly where we were going. We went into the toilets and I put my hand over her eyes so she wouldn't get grossed out, but she already knew where we were as I did this after we had walked in. She still displayed no sign of discomfort. I went in to a cubicle with her and attempted to pull her underwear down from under her skirt, she then informed me she was wearing a skort. Meaning, I had to pull the whole thing down, which I did. A few moments later, a security guard came in and got us out of the bathroom. I walked home and messaged her on snapchat, telling her sorry I left, asked her what happened, and if she was ok. A few hours later the police knocked on my door and arrested me for sexual assault and attempted rape. I told the police everything I've mentioned in this post, and after my interview, my duty solicitor told me he thinks I aced it. From what little I heard of the victim statement, she doesn't say anywhere that she said no, or made any action to signal her being uncomfortable, but she did say that I pulled her to the toilets and put my hand on her neck in the cubicle.
I'm guessing because the police never mentioned her saying anything along those lines then the case rests on proving that she was too drunk to consent, which clearly isn't true. The police photographed my hickey and have collected CCTV and witness statements. My bail period ends in a few days. I do have a duty solicitor, as I mentioned, and I'm not sure I could afford a lawyer. Should I look into legal advice further than speaking to my duty solicitor?
