Hey all, so long story short I’ve gone through mediation which failed and received a position statement. In it, I’ve found tons of omissions as well as lies, including claims that protected activities never occurred. They are claiming I was a bad employee from day 1 but all my reviews were positive until stuff started to happen with trying to PIP me. I have multiple points of evidence printed out to show reviews as well as positive interactions. I also can request and show that I have protected activities with reporting stuff to employee concerns and HR may times as well as an ADA disclosure and continuing of treating me poor within a 2 month window as well as firing me while a live Employee Concerns investigation was going. Would this be a compelling rebuttal that the EEOC might take seriously?
