Barclays denied my fraud dispute multiple times, can I take them to small claims court or do I have to do arbitration?
Hi,
Had a fraudulent charge on my Barclays card while I was in UK that they keep refusing to reverse. I've gone through their dispute process, filed a CFPB complaint, and contacted their Office of the President. Nothing has worked.
I looked at my Cardmember Agreement and it has an arbitration clause but also mentions that you can go to "the equivalent court in your home jurisdiction" as an alternative. I'm in Massachusetts so I'm thinking that means small claims court.
Has anyone dealt with Barclays or a similar bank in this situation? Can I go straight to small claims or do I have to start arbitration first? Any advice would be really helpful.
