Builder asked to return the commission due to buyer refused to close
Ontario pre-con commission clawback question:
Builder is trying to recover milestone commissions paid 4 years ago after purchaser failed to close. Co-op agreement had no explicit clawback clause. Final closing commission was never paid.
Instead of contacting the agent directly, the developer deducted the amount from brokerage other unit commissions.
Anyone seen this happen before in GTA/Ontario?
