I recently sold my car in Victoria, Australia under the following conditions:
- Sold as-is, no roadworthy certificate (RWC)
- Registration still active with about 1 month left
- Buyer and I have already signed a payment receipt + transfer papers (VicRoads forms)
- However, the buyer told me not to submit the Notice of Disposal to VicRoads yet
- He said he will organise the RWC first and then transfer the title later
The issue is:
I’ve already filled in the transfer paperwork, but I have NOT lodged the Notice of Disposal online yet on VicRoads because he asked me to wait.
Now I’m worried:
- The car is still under my name in the system
- What if he gets speeding or parking fines?
- Am I still legally responsible if I haven’t lodged the Notice of Disposal?
- Is there any risk of fraud or misuse here?
Should I just lodge the Notice of Disposal immediately with VicRoads even if the buyer asked me not to?
Has anyone dealt with a similar situation?
