Auto accident bad faith claim?
I live in Pinellas county Florida, and was involved in a car accident about 5 months ago. The other party, a motorcycle, was at fault. I decided to use my own insurance for the repair.
There was a large gap between the amount the repair shop wanted to do the repair vs what the insurance wanted to pay for the repair (27k vs 15k). I invoked the Right to Appraisal (RTA) clause and hired a third party appraiser, and my insurance did the same. Both third party appraisers worked together for about 2 months and an appraisal award letter was reached. In there, it states my car reached above a certain repair threshold amount and the car deemed a total loss. My insurance however wanted the appraisal to continue all the way to determine the full repair amount; however, my appraiser said the appraisal is complete and nothing further is being done by him and the other appraiser.
There is no injury involved, and i have reached out to some local law firms but they all seem to deal with only injury related. My car has been in the shop for about 5 months now. The insurance paid for the first 6 weeks and I have been paying out of pocket since. Communication is stalled with my insurance and they just don't care.
Anyone here think I have a good case for bad faith claim or any other violation?
