I moved out nearly a week ago (apr30) and returned my keys. The landlord is refusing to return the key deposit as we’re currently disputing/discussing another charge (like dmg in the unit). I looked online and overall it suggests that it’s illegal to do this and the separate charge should be handled separately, but I can’t find a specific law that says this.

If I go to LTB over the key deposit, will I definitely win?

Also separate question, I’ve seen that if a tenant wins, the landlord is responsible for the filing fee. Do I include that in my application?

Is this considered normal wear and tear? This is a video from Apr 15 and the landlord just fixed it May 1 (I moved out on Apr 30). This is the only video I have of the doorknob (I realize I probably should have documented better), but when I moved out, it got much worse since it wasn't fixed and it kept ripping out of the wall if that makes sense.

The landlord is trying to charge me for the repair and says "this has never happened before so it is clearly you who mishandled it" and that the building manager said "this was clearly broken by who was living in the unit."

I used the doorknob normally throughout my tenancy, but I guess if this is considered intentional damage, I'm willing to pay
