Grounds to end the lease?
Backstory:
My partner and I, his friend and another guy are living in a 3 bed flat and our lease ends in September. We are on working holiday visas and needed accommodation pretty quickly so decided to go for this as the lease was only 6 months. The flat is an old, ground floor flat which gets 0 sunlight and I’ve spotted mould in the bathroom and on my bedroom ceiling.
I suffer from asthma and hayfever badly and I’m also waking up with daily allergies even though it’s Sydney winter time. I’m fine when I’m at work so I’m putting it down to this flat being dusty/mouldy. I’m so unhappy here and me and my partner want to leave now and get our own place.
I think we may have some grounds to end the lease. 1. There was no pre-moving in clean and when we arrived the old tenants still had most of their belongings here which we had to help carry upstairs (they moved into the flat above). The flat had not been cleaned anywhere and I spent the first weekend deep cleaning the house.
2. We never received any information on our bond being held legally so I am worried the landlord has not done this.
3. The mould is causing me to have constant allergies which also in turn is making my hair shed crazy amounts (I think it’s something to do with my immune system) which is worrying me.
He also didn’t do a condition report when we moved in.
Do we have a case here? I don’t want to go down the legal action route so I’m considering just asking for a middle ground of the landlord lets us leave with no fees or fuss and we don’t take legal action. This is in Sydney NSW.
