Fixed term tenancy in Ireland, terminating tenancy early, assignment and landlord refusing consent
Hi, I’m looking for advice from anyone familiar with Irish residential tenancy law.
I’m currently in a fixed term tenancy for an apartment in Dublin. I got an offer of a job paying really well in cork and after some difficult circumstances since moving in, including my car being stolen from the apartment’s underground car park, I have asked the management company whether the landlord would agree to a mutual surrender of the tenancy.
My questions are:
Can I formally request the landlord’s consent to assign the tenancy to a replacement tenant, even though the tenancy is fixed term?
If the landlord refuses consent to the assignment, does that refusal give me a statutory right to terminate the fixed term tenancy under section 186?
Would I make that request through the management company, as the managing agent, rather than contacting the landlord directly?
If this applies, what notice period/procedure would I have to follow to terminate the tenancy legally?
I’m not looking to simply walk away from the lease or stop paying rent. I’m trying to understand the proper legal route if the landlord won’t agree to a mutual surrender.
Any advice from someone who’s actually dealt with this in Ireland would be really appreciated.
