My car was hit in January of this year by a Provisional driver, found out about a week ago his insurance turned him down due to not being insured to drive a turbo car. Fast forward to today, the place my car [which is a write off] has been stored for the past 4 months has called to find out the situation..
For reference, cars worth about $30k
Car yard where it's being stored is saying it's $3.5k and adding $40 per day.
Assessor to have paperwork of cars worth $600
Nobody was in my car for the accident so there's no question of who's at fault
Now normally insurance covers all costs, but since I've been left out to dry, Do I cover the costs for everything and then add those totals into a letter of demand for the at fault party? Or do I forward these bills onto the at fault driver before paying them myself? I don't want to fork out upwards of $4000 just to be told in court I shouldn't of been the one to pay in the first place.
What's the procedure here?
TIA for any advice, I'm legally illiterate and don't know what to do.
