Messed up with totaled car I can’t afford

23, without the car financing, about 3900 in a loan, 2100 in credit card, credit was 740. In January, I was working at a very well paying job where the car payment wasn’t hurting me. $390 a month on top of like $200 for insurance. brand new car, totaled it around August of last year. It had gap coverage on it. I assumed everything would just figure itself out. Well come to find out the financing company sent my documents to “the wrong email” provided by the dealership for the gap coverage agency. I don’t understand how this is true because they faxed it to the number listed on the dealerships paperwork when i bought the car and the email as well within 90 days of the accident.

Fast forward to January, I faced an injury and lost my well paying job. Then literally a week after I put in my two weeks notice, started receiving all these calls from the financing company stating “the gap coverage company is saying that we sent the information to an incorrect email, you need t pay these debts” etc.

I lost my job, and was unemployed for a little over a month. I didn’t necessarily “refuse to pay” the oncoming bills of financing the car, but I quite literally can’t without breaking into my 401k and I already took out 2k to cover my month of unemployment. So basically I have missed payments showing up on my credit report since January despite the financing lender company making me sign all these papers that discontinued my autopay back in November. So my thing is, if it wasn’t even confirmed that gap company was going to send the money, why take me off the payments?

Idk what to do anymore. I contacted the ohio general attorney and they incorrectly complained with the dealership and autocap saw them not at fault. I’m considering filing for bankruptcy at this point but no bankruptcy attorney is calling me back in Cincinnati. They keep referring me to the Ohio state bar association.
