I won a conciliation appeal court case and have been waiting for the defendant to pay for 10 years (9yrs., 9mo.) Unfortunately they haven’t, so earlier this year I started to work through the collection process. I know I shouldn’t have waited this long but here we are.

I submitted a Motion to Show Cause to the court and scheduled the court date. The only open court date happens to be PAST the 10 year mark on the judgment, which is the point of expiration in my state. The court still scheduled the date even when I told them about the expiration, but they didn’t seem to know if it would be okay.

I have a few questions:

Will the Judge still hear my case since I scheduled the court date before the judgment expired? Or do I need to cancel that and renew/extend the judgment instead? I’m worried about showing up and nothing will happen because my case expired.

What are the usual outcomes from a Motion to Show court case? Can the Motion to Show extend the deadline of the judgment and get the defendant to still pay?
