1/2 inch notch in 2x4 ceiling joist for HVAC return

I’m having a ducted mini split installed in my attic as a second zone upstairs in an older home. I was explicit with the HVAC contractors that I didn’t want to compromise or mess with any framing in the attic, even if it means things being off center or placed in weird spots etc.

For the return vent they said they could still place it horizontally above the stairwell without cutting any joists, as opposed to vertically in between the joists. They were able to get the ductwork in around the joists but the return vent and filter housing won’t sit flush with the ceiling. They’re asking if they can notch out 1/2 inch from both the 2x4s in the pics the width of the vent opening which is 14”. There’s no other weight in the attic other than the equipment, the air handler is suspended.

Thankfully, they asked before cutting into the joists but the two options they proposed were silicone around the 1/2” gap between the vent housing and the ceiling or notching the joists. Would that notch have structural implications? Any other solutions?
