Hi all,

I am a USC, living with my spouse. Our adult USC child has applied for the GC for my spouse, since he is living in the US. I have a question regarding my spouse visiting the US while waiting for the GC application to be processed/approved. My spouse has a 10 year re-entry visa (his third one since we married in 1998).

My spouse and I are living and working overseas while we wait. The application was filed (July 2025) but my spouse has not entered the US since September 2024, just to avoid any issues at immigration.

I go back and forth frequently to visit both of our young adult children. It's been extremely difficult for my spouse not to enter the US for this long, especially as we have family there, own a home there and have spent summers there for the past 30 years. (My spouse and I have been married for over 28 years and lived overseas the whole time. Our plan is for him to move back as soon as the GC comes through with me following a couple of years after that, closer to retirement, since our children are now grown.)

Now that the approval estimated dates (on TMVN) are changing daily (his date is now estimated to be the end of December), we are reconsidering whether he should start to go in for visits. While we thought it better he stay out during the waiting period, now we are wondering two things:

  1. Is it risky for him to try to go in? 2. Would it actually be better for his application if he shows that he is going in for visits with our USC children? 3. If he goes in, would it be best that he and I go in together? (Of course, we would have return tickets and other proof of our lives overseas.)
