Hey I just wanted to share what lawyers have told me. I’ve consulted with a few and I’ve seen this come up a few times.
All of them (in different states) cautioned that this wouldn’t work. It’s one: very expensive, but also it is hard to argue DACA because it’s “discretionary approval”. It’s hard to prove that processing delays are outstanding when it’s at discretion.
You also need to make sure you’re exhausting ALL possible options before this. Even if they’re dead ends, you need to showcase you’re not just “waiting”. So congressional inquiries, expedited requests, etc. They’re all needed to build the case and show that you’ve done your due diligence.
That said, historically, USCIS hasn’t fought these. The current administration does. They will hold up these in litigation and will get very expensive. It’s just a trend they’re all seeing.
Obviously, no one told me “no”. They were all kind in explaining in detail the road ahead for this.
I’m not sharing this to discourage anyone. Please do what works best for you. I just want to share the information I’m getting .
